1. INTERPRETATION

1.1 The definitions and rules of interpretation in this rule apply in these Rules.

Partnership: The RES Forum is a partnership trading as “RES Forum”.

Member: the person, firm or company who wishes to attend a training session/s organised by The RES Forum or a RES Forum Technical Partner

Intellectual Property Rights: all patents, rights to inventions, utility models, copyright and related rights, trademarks, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in designs, rights in computer software, database right, topography rights, moral rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world.

1.2 Headings in these Rules shall not affect their interpretation.

1.3 A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality).

2. PROVISION OF TRAINING SESSION/S

By confirming in writing that the booking request submitted by the Member is approved, the RES Forum agrees to provide the relevant training session to the Member.  However, the RES Forum reserves the right, without any liability to the RES Forum, to postpone or cancel a training session, or to cancel the Member's booking, if it in its absolute discretion determines that it is necessary or desirable to do so.  The RES Forum will use its reasonable endeavours to provide notification to the Member of any such postponement/cancellation.

3. INTELLECTUAL PROPERTY RIGHTS

As between the Member and the RES Forum, all Intellectual Property Rights and all other rights in The RES Forum concept and website shall be owned by the RES Forum.

4. DISCLAIMER

4.1 Training sessions are provided solely as guidance for Members of the RES Forum and are not, and should not in any circumstances be treated as, a substitute for formal advice.  Neither the RES Forum not the third party suppliers of any training session accepts any responsibility for loss arising directly or indirectly from reliance on information and/or materials obtained via any training session.

4.2 The RES Forum and the third party suppliers of any training session exclude all liability and responsibility for any amount or kind of loss or damage that may result to the Member or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with any training session in any way or in connection with the use, inability to use or the results of use of information and/or materials obtained via any training session.

4.3 Nothing in this rule 4 shall exclude or limit the RES Forum's liability for:

(a) death or personal injury caused by negligence; or

(b) fraud; or

(c) any liability which cannot be excluded or limited under applicable law.

5. DATA PROTECTION

The Member acknowledges and agrees that details of the Member’s personal data may be processed by and on behalf of the RES Forum in connection with the provision of a training session and may be disclosed to the third party supplier of the relevant training session/s.
